Comprehensive Representation

Assertive legal counsel for complex Texas divorces

Separating a marital estate in divorce can be a complex process, especially for business owners or individuals with high net worth. Our in-depth knowledge of Texas family law becomes a meaningful advantage in your situation. We have handled some of the most complex divorce cases in the state and work to make this process as seamless as possible for you.

Across the marriage and divorce side of our practice, we represent clients through annulment and legal separation, the full Texas divorce process, high net worth and military divorces, and matters involving professional practices and closely-held businesses. We guide spouses through both contested and uncontested filings, common-law marriage disputes, same-sex divorces, and the negotiation or enforcement of prenuptial and postnuptial agreements.

On the financial side, we focus on protecting what you've built. Our attorneys handle marital estate and property division, alimony and spousal support, and the careful identification of marital versus nonmarital property — including hidden assets and complex debt. We routinely advise on the division of retirement accounts, pensions, IRAs and 401(k) plans, and coordinate business valuations and tracing with trusted financial professionals.

Texas Family Code

Grounds for divorce in Texas

Texas recognizes both no-fault and fault-based grounds. The ground you file under can shape how the court divides property, evaluates conduct, and approaches spousal maintenance — making early strategic counsel essential.

Insupportability

Texas's no-fault ground — irreconcilable differences that destroy the legitimate ends of the marriage with no reasonable expectation of reconciliation.

Adultery

An at-fault ground that may influence the just-and-right division of the marital estate when properly proven.

Cruelty

Conduct of one spouse toward the other that renders further living together insupportable, often relevant to property awards.

Felony Conviction

A spouse convicted of a felony and imprisoned for at least one year may be grounds for divorce under Texas law.

Abandonment

Voluntary abandonment by a spouse with the intention of leaving for at least one year supports a fault-based filing.

Living Apart

Spouses who have lived apart without cohabitation for at least three years may pursue divorce on this ground.

Areas of Focus

Every kind of divorce, handled with the same standard of care

Contested Divorce

When spouses disagree on property, conservatorship, or support, our attorneys prepare a thorough strategy and advocate firmly in court when negotiation falls short.

Uncontested Divorce

For couples in alignment, we streamline the documentation, negotiation, and filings so you can resolve matters efficiently — without unnecessary delay or expense.

High Net Worth Divorce

Complex estates, businesses, and investment portfolios require careful valuation, tracing, and tax planning. We coordinate with trusted financial professionals throughout.

Military Divorce

Service members and spouses face unique rules around residency, pensions, and the Servicemembers Civil Relief Act. We guide you through every nuance.

Same-Sex Divorce

We bring the same dedicated, judgment-free representation to same-sex couples navigating dissolution, custody, and property division in Texas.

Pre/Postnuptial Disputes

When the validity or enforcement of a marital agreement is at issue, we draw on decades of family-law litigation experience to protect your position.

How It Works

A clear roadmap through the Texas divorce process

Every divorce is unique, but most Texas matters move through a recognizable series of steps. Knowing what to expect is one of the most powerful things you can do for yourself.

  1. 1

    Confidential Consultation

We begin with a private conversation to understand your goals, your family, and your immediate concerns — and to outline the realistic options ahead.

  2. 2

    Strategy & Filing

We prepare your petition, financial disclosures, and any necessary temporary orders, building a strategy tailored to your case from day one.

  3. 3

    Discovery & Negotiation

We gather the information needed to value the marital estate, analyze custody dynamics, and pursue resolution through negotiation or mediation.

  4. 4

    Trial Preparation

When agreement isn't possible, we prepare meticulously for court — exhibits, witnesses, and a clear narrative that protects your interests.

  5. 5

    Final Decree & Beyond

After the court signs your final decree, we help you implement orders, transfer assets, and address any post-decree issues that may arise.

Avoid Costly Missteps

Common mistakes to avoid during a Texas divorce

The decisions you make in the first 30 days often shape the next 30 months. Here are the missteps we most often see — and help our clients steer clear of.

01

Posting on social media

Photos, check-ins, and offhand posts routinely become exhibits. Pause public sharing the moment you contemplate divorce.

02

Hiding or moving assets

Texas courts treat asset concealment seriously. Transparent disclosure protects you from sanctions and an unfavorable division.

03

Making major financial moves

Avoid large purchases, transfers, or refinancing without counsel — they can disrupt the status quo and complicate temporary orders.

04

Speaking negatively about your spouse

Especially in front of the children. Courts watch how each parent supports the child's relationship with the other.

05

Trying to navigate it alone

Texas family law is nuanced. Early counsel almost always saves money, time, and avoidable heartache.

06

Signing without legal review

Never sign agreements, waivers, or financial statements presented by your spouse before an attorney has reviewed them.

60-Day Waiting Period

Texas requires at least 60 days from filing before a divorce can be finalized.

Community Property State

Most assets acquired during marriage are subject to a just-and-right division.

Residency Requirement

One spouse must have been a Texas resident for 6 months and a county resident for 90 days.

Frequently Asked

Texas divorce questions, answered

How long does a divorce take in Texas?
Texas requires a 60-day waiting period from filing before a divorce can be finalized. Uncontested matters can finalize shortly after that window; contested cases involving custody or complex property can take several months to over a year.
Is Texas a community property state?
Yes. Most property acquired during the marriage is presumed community property and subject to a just and right division. Separate property — generally property owned before marriage or received by gift or inheritance — must be properly identified and traced.
Do I need to prove fault to get divorced?
No. Texas allows no-fault divorce on the ground of insupportability. Fault grounds such as adultery or cruelty may still be relevant to property division and other issues in some cases.
Will I have to go to court?
Many Texas divorces are resolved through negotiation or mediation without a trial. When trial is necessary, our attorneys are prepared to advocate aggressively on your behalf.
